Sony has more than legal difficulties facing them at the moment on top of being asked to produce documents in the Microsoft Activision case. They were taken to court in 2020 by several players of the FIFA franchise. This story was reported by Games Wirtschaft. The problem the FIFA players have surrounds the FIFA Ultimate Team mode. The part of this mode in question and mentioned in the lawsuit is the player packs.
Naturally, the game FIFA Ultimate Team is not a Sony property. However, they make money from the sale of player packs through their store. When players finally took legal action it seems an Austrian court listened. One case mentioned is one gamer represented by a lawyer called Ulrich Salburg. He claims his “client is said to have ‘gambled away’ €400 on the console by buying FIFA points in the FIFA football game from Electronic Arts. This can be used to unlock randomly generated football stars – anyone who can place Benzema in midfield or Neuer in goal will inevitably have game-changing advantages in online games”. It is true, I’ve seen loads of social media posts about people buying several packs just to hopefully get a world class player. It’s one reason I’ve never personally played the mode.
How The Courts Ruled In the Case With Sony And The Fifa Ultimate Team Player Packs
The Austrian court has in effect sided with the plaintiffs. They decided Sony needs to pay out refunds due to the player packs with FIFA Ultimate Team being deemed a form of gambling. The article from Germany says that they “violated the Austrian gambling monopoly with loot boxes in the FIFA football game.” It’s been a controversial mode for several countries around the world for several years. How it will affect the mode going forward we don’t know. We do know this is the last FIFA game before it changes name.
